Privacy Shield: Enactment of New European Union Privacy Rules for U.S. Companies

Even for those who do not regularly deal with conflicts between privacy law in the United States and European Union (EU), the last few months have demonstrated clear and fundamental differences in the way privacy is viewed under the two legal systems. An article in the Economist characterized the EU approach as viewing data privacy as a human right, while the U.S. treats it primarily as an issue of consumer protection.

Until October 2015, the conflict was addressed under the EU’s Safe Harbour Privacy Principles.
